Form I-751 is used to remove the conditions on a conditional permanent resident status that was granted based on a marriage of less than two years. Conditional residents receive a 2-year green card and must file I-751 within the 90-day window before it expires to obtain a permanent 10-year green card.
The I-751 petition must demonstrate that the marriage was entered in good faith and not for immigration purposes. Evidence typically includes joint financial accounts, property ownership, birth certificates of children, affidavits from family and friends, and photos documenting the marriage.
If the marriage ends before filing (through divorce, death, or abuse), waivers allow filing without the spouse. The I-751 process includes biometrics, potential interview, and extended processing times. While the case is pending, the conditional resident's status is typically extended automatically.

Strong evidence includes: joint bank accounts, joint tax returns, shared lease/mortgage, insurance beneficiary designations, birth certificates of children, affidavits from people who know your marriage, photos together over time, travel records, and correspondence addressed to both.
You can file I-751 with a divorce waiver. You'll need to show the marriage was genuine when entered (not just to get a green card) and provide your divorce decree. The burden of proof is higher, and the petition is filed in your name alone without your ex-spouse.
Not all I-751 cases require interviews. USCIS may waive the interview if the evidence is strong and there are no red flags. However, you should be prepared for a possible interview where you'll answer questions about your marriage and relationship.
When you file I-751, you receive a receipt notice that extends your status for 24 months. As of 2024, USCIS issues a 48-month extension for many cases. You remain a lawful permanent resident while the case is pending, even if your physical card has expired.
