Overview
The H-1B visa is the most widely used work visa for foreign professionals in the United States. It allows U.S. employers to hire foreign workers in specialty occupations that require theoretical or technical expertise in a specialized field such as IT, engineering, mathematics, science, medicine, and more.
To qualify, the position must require at least a bachelor's degree (or equivalent) in a specific specialty, and the worker must possess the required degree or its equivalent. The H-1B is employer-sponsored, meaning a U.S. company must petition on behalf of the worker.
The visa is initially granted for up to three years and can be extended for a maximum total stay of six years. After six years, the worker must leave the U.S. for at least one year before reapplying, unless they have an approved I-140 or are in the green card process.

A specialty occupation is one that requires the theoretical and practical application of a body of highly specialized knowledge and a bachelor's degree or higher in the specific specialty (or its equivalent). Common examples include software developers, engineers, accountants, architects, doctors, and college professors.
Due to high demand, USCIS conducts an annual lottery to select which H-1B petitions it will accept for processing. The lottery typically opens in March for employment starting October 1. If your petition is not selected, your employer cannot proceed with the H-1B filing for that fiscal year.
Yes, H-1B visa holders can change employers. The new employer must file a new H-1B petition on your behalf. Under H-1B portability rules, you can begin working for the new employer as soon as the petition is filed, without waiting for approval.
H-4 dependent spouses may be eligible for work authorization (H-4 EAD) if the H-1B holder has an approved I-140 immigrant petition or has been granted H-1B status beyond the standard six-year limit based on pending green card processing.
Generally, you must leave the U.S. for at least one year before being eligible for another H-1B. However, if you have an approved I-140 or a labor certification pending for at least 365 days, you may be eligible for H-1B extensions beyond the 6-year limit in one-year or three-year increments.
